Smart Path Terms of Service

Overview

Smart Path is a business growth program delivered by Path Connect for independent allied health clinicians and small providers.

By enrolling in Smart Path, participants agree to these Terms of Service in addition to the applicable Privacy Policy.

Enrolment and Payment

Enrolment is confirmed once payment has been successfully processed.

Participants may enrol through either:

Full payment; or

An approved payment plan.

Where a payment plan is selected, participants agree to complete all scheduled payments.

Failure to maintain payment obligations may result in suspension or removal of access to Smart Path and associated resources.

Early Bird and Promotional Pricing

Path Connect may offer discounted, promotional or early bird pricing from time to time.

Unless otherwise stated, promotional pricing is limited and available on a first come, first served basis.

Path Connect reserves the right to modify, withdraw or end promotional pricing at any time.

Promotional pricing cannot be applied retrospectively to existing enrolments.

Withdrawals, Transfers and Refunds

Participants who are unable to attend may request to withdraw from the program prior to commencement.

Where at least 14 days' notice is provided before the program commencement date, Path Connect may, acting reasonably and at its discretion:

Transfer the participant to a future intake; or

Provide a refund less any applicable administration, transaction or third-party processing fees.

Once the program has commenced, refunds are generally not available due to the limited number of places available and the immediate access provided to workshops, recordings, resources and community content.

Requests relating to exceptional circumstances may be considered by Path Connect on a case-by-case basis.

Nothing in these Terms excludes any rights available under Australian Consumer Law.

Program Delivery

Path Connect will make reasonable efforts to deliver the program as described.

Workshop dates, guest speakers, content, resources and delivery methods may be adjusted where reasonably necessary.

Participants will be notified of significant changes where practical.

Participant Responsibilities

Participants are responsible for:

Maintaining respectful and professional conduct;

Participating in accordance with community guidelines;
Protecting the confidentiality of other participants where applicable;
Ensuring their contact details remain accurate; and
Complying with all applicable laws and professional obligations.

Community Participation

Smart Path includes access to the Path Connect community.

Participants must comply with all community guidelines and standards.

Path Connect reserves the right to suspend or remove access where behaviour is considered inappropriate, disruptive, unlawful or harmful to the community.

No refund will be provided where access is removed due to a breach of these terms.

Intellectual Property

All program materials, recordings, templates, worksheets, presentations and resources remain the property of Path Connect unless otherwise stated.

Participants may use program materials for their own personal and business purposes but may not reproduce, distribute, sell, publish or share materials without prior written permission.

Recordings

Workshops, discussions and events may be recorded and made available to participants.

By participating, participants acknowledge that their name, comments, questions or contributions may appear within program recordings.

Results Disclaimer

Smart Path provides education, guidance, resources and peer learning opportunities.

Individual outcomes will vary.

Path Connect does not guarantee any specific business, financial, professional or personal results arising from participation in the program.

Limitation of Liability

To the maximum extent permitted by law, Path Connect is not liable for any direct, indirect or consequential loss arising from participation in Smart Path.

Participants remain responsible for their own business, financial, clinical and professional decisions.
